Terms of Service

1. Agreement to Terms
These Terms of Service (“Terms”) govern your access to and use of Canba Health’s website, mobile application, and related services (collectively, the “Services”), provided by Canba Health, Inc. (“Canba Health,” “we,” “us,” or “our”). By creating an account or otherwise using the Services, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Services.
2. Eligibility
You must be at least 18 years old, or the legal age of majority in your jurisdiction, to create a Canba Health account. Age is self-attested at account creation. If you are using Canba on behalf of another person (for example, as a caregiver managing information for a patient), you represent that you have the legal authority or permission to do so, and that you will use any information you access solely for that purpose.
3. Description of the Services
Canba Health is a companion platform designed to help people affected by cancer — patients and their caregivers — organize and navigate their care. The Services may include care coordination tools, treatment and symptom tracking, appointment and document management, caregiver collaboration features, and AI-assisted explanations of health information.
The Services are informational and organizational tools only. They are not a substitute for professional medical advice, diagnosis, or treatment, and are not a medical device.
4. Medical Disclaimer
Canba Health does not provide medical advice, diagnosis, or treatment, and no content within the Services — including AI-generated explanations — should be interpreted as such. Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition or treatment. Never disregard professional medical advice or delay seeking it because of something you read or received through the Services.
If you are experiencing a medical emergency, call 911 (or your local emergency number) immediately. Canba Health is not a crisis or emergency service and cannot respond to emergencies.
5. Your Account
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to provide accurate information when creating your account and to keep it up to date. Notify us promptly at support@canbahealth.com if you suspect unauthorized use of your account.
6. Subscriptions and Payment
Canba Health uses a freemium model: core features for patients are offered free of charge. Certain caregiver features may require a paid subscription. Paid subscriptions are sold exclusively through the Apple App Store and Google Play (each, an “App Store”), and are billed and processed by the applicable App Store, not directly by Canba Health.
• Your purchase, billing, auto-renewal, and cancellation are governed by the applicable App Store’s payment terms, in addition to these Terms. To cancel or manage a subscription, you must use the subscription management tools provided by the applicable App Store; cancellation takes effect at the end of the current billing period.
• Refunds for App Store purchases are handled by Apple or Google in accordance with their own refund policies, not by Canba Health directly.
• Prices are set within the applicable App Store and are subject to change with advance notice as required by that store’s policies. Continued use of paid features after a price change takes effect constitutes acceptance of the new price.
• If we introduce additional payment methods in the future (for example, billing directly through our website), we will update this section accordingly.
7. Acceptable Use
You agree not to:
• Use the Services for any unlawful purpose or in violation of these Terms.
• Impersonate any person or misrepresent your affiliation with a person or entity.
• Upload or share information about another person without their knowledge or permission, except as reasonably necessary for caregiving purposes you are authorized to perform.
• Attempt to gain unauthorized access to the Services, other accounts, or our systems.
• Reverse engineer, scrape, or use automated means to access the Services, except as permitted by applicable law.
• Use the Services to harass, threaten, or harm another person, or to post unlawful, defamatory, or infringing content.
We may suspend or terminate accounts that violate this section.
8. Your Content
You retain ownership of the information and content you submit to the Services, including health information you choose to add (“Your Content”). By submitting Your Content, you grant Canba Health a limited, non-exclusive license to host, store, process, and display Your Content solely as necessary to provide and improve the Services to you, in accordance with our Privacy Policy. We do not sell Your Content and do not use your health information to train AI models operated by us or, per our agreements with AI providers, by them.
You are solely responsible for the accuracy of the information you submit. Canba Health is not responsible for decisions made based on information you or a caregiver enter into the Services.
9. AI Features
The Services may use artificial intelligence to help explain medical reports, lab results, and other health information in simpler language. AI-generated content is provided for informational purposes only, may contain errors, and is not medical advice. You should independently verify any AI-generated explanation with a qualified healthcare provider before relying on it. Additional detail on how we use AI and share information with AI providers is available in our Privacy Policy.
10. Caregiver Access
If you invite a caregiver to your account, you control what information that caregiver can access, and you may revoke their access at any time through your account settings. Caregivers may only use information they access through the Services for the purpose of supporting the patient who granted access, and not for any other purpose.
11. Intellectual Property
The Services, including their design, text, graphics, logos, and underlying software, are owned by Canba Health or our licensors and are protected by intellectual property laws. Except for the limited rights expressly granted to you to use the Services, no other rights are granted, and all rights not expressly granted are reserved by Canba Health.
12. Termination
You may stop using the Services and delete your account at any time through your account settings. We may suspend or terminate your access to the Services if you violate these Terms, if required by law, or if we discontinue the Services, in each case with notice where reasonably practicable. Sections of these Terms that by their nature should survive termination (including Sections 4, 8, 13, 14, and 15) will survive.
13. Disclaimers and Limitation of Liability
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY HEALTH-RELATED INFORMATION PROVIDED THROUGH THE SERVICES, INCLUDING AI-GENERATED CONTENT, WILL BE ACCURATE OR COMPLETE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CANBA HEALTH AND ITS OFFICERS, EMPLOYEES, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, ARISING FROM YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR (B) $100. SOME JURISDICTIONS DO NOT ALLOW THESE LIMITATIONS, SO THEY MAY NOT APPLY TO YOU.
14. Indemnification
You agree to indemnify and hold harmless Canba Health and its officers, employees, and service providers from any claims, damages, or expenses (including reasonable attorneys’ fees) arising from your violation of these Terms, your misuse of the Services, or your violation of any rights of another person.
15. Governing Law and Disputes
These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles, except where applicable law requires otherwise. Before filing a formal claim, you agree to first contact us at support@canbahealth.com so we can attempt to resolve the dispute informally. Any dispute that cannot be resolved informally will be subject to the exclusive jurisdiction of the state or federal courts located in Delaware, and you consent to personal jurisdiction there.
16. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you through the Services or by other appropriate means before the changes take effect. Your continued use of the Services after changes become effective constitutes acceptance of the updated Terms.
